Terms of Service — ARABICKHAT

1. Introduction

Welcome to ARABICKHAT. By accessing or placing an order through our website (arabickhat.com), you agree to comply with and be bound by these Terms of Service (“Terms”). These Terms govern your use of our website, digital products, and custom calligraphy services.

If you do not agree with any part of these Terms, please do not use our services or download our products.

2. Products and Services

We offer two main categories of digital products and services:

  1. Ready-made Digital Calligraphy Artworks: Pre-designed Arabic calligraphy files (e.g., “Bismillah”, “Eid Mubarak”, “Alhamdulillah”, etc.) available for instant download.
  2. Custom/Commissioned Calligraphy Services: Personalized calligraphy artworks created upon request (e.g., your name, brand name, or logo design).

3. Licensing and Usage Rights

3.1 Standard License (Ready-made Products)

By purchasing or downloading a ready-made digital artwork, you are granted a non-exclusive license under the following terms:

  • You may use the artwork for personal and limited commercial purposes.
  • You may modify, recolor, or resize the design for your own project.
  • You may print or apply the design on physical products (such as posters, apparel, books, or packaging) up to 1,000 units.
  • For usage beyond this limit, please contact ARABICKHAT for an extended commercial license.
  • You may use the artwork in personal or client digital projects.

You are NOT allowed to:

  • Resell, share, or redistribute the original source files.
  • Claim this artwork as your own creation.
  • Include the files in any digital product, template, or bundle intended for resale.
  • Use the artwork for AI training datasets or NFT generation.
  • Use the artwork for illegal, fraudulent, or deceptive purposes.

3.2 Exclusive Custom License (Commissioned Works)

For custom calligraphy orders (e.g., name, logo, or brand design), an exclusive license will be granted under the following conditions:

  • You receive exclusive usage rights for the commissioned artwork — it will not be resold, reused, or distributed to others.
  • You may freely use it for branding, identity, marketing, or any personal/commercial purpose (no 1,000-unit limit).
  • ARABICKHAT retains copyright and moral rights as the original creator, but full usage rights are granted to you as the client.
  • You may not resell or redistribute the original editable files.
  • You may not claim authorship of the artwork.

3.3 General License Terms (Applicable to All Products)

  • All digital artworks are created legally, without the use of unauthorized or illegal tools or methods.
  • ARABICKHAT is not responsible for any misuse, deceptive act, or unlawful use of the artwork by users.
  • The user is fully responsible for how the product is used.
  • Purchasing or downloading any product does not transfer copyright ownership.

4. Permitted and Restricted Use

Permitted Use:

  • Use in personal, client, or business projects under the terms of the granted license.
  • Printing or incorporating designs into physical items within license limitations.
  • Modification for size, color, or composition according to your project.

Restricted Use:

  • Reselling, redistributing, or sharing source files.
  • Claiming the artwork as your own creation.
  • Using the artwork in products or templates for resale.
  • Using the artwork for AI training or NFT projects.
  • Using the artwork for illegal, fraudulent, or harmful activities.

5. Ownership and Intellectual Property

All artworks remain the intellectual property of ARABICKHAT. Licenses grant usage rights only and do not transfer ownership.

Even for custom/commissioned works, ARABICKHAT retains copyright and moral rights, while exclusive usage rights are granted to the client.

6. Refund and Support Policy

All sales are final and non-refundable due to the digital nature of our products.

However, ARABICKHAT gladly provides full support if you experience any issue with downloading or using your purchased files.

7. Limitation of Liability

ARABICKHAT and its affiliates shall not be held liable for any indirect, incidental, or consequential damages arising from the use or inability to use our products or services. We are not responsible for violations, misuse, or damages caused by improper application of our artworks.

8. Updates and Revisions

ARABICKHAT reserves the right to modify or update these Terms of Service at any time. Any updates will be reflected on this page with a revised effective date. Licenses granted prior to updates will remain valid under their original terms unless otherwise agreed in writing.

9. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted under the laws of Indonesia, without regard to conflict of laws principles. Any dispute arising from these Terms shall be resolved in the courts of Indonesia.
